Vertragsbestimmungen (05.07.2016)

Zwischen der iHaus AG, Siedlerstraße 2, 85774 Unterföhring („iHaus“), und Ihnen (dem „Nutzer“) gelten die nachfolgenden aus

I. Leistungsbeschreibung,

II. Allgemeinen Geschäftsbedingungen („AGB“) und

III. Drittlizenzbedingungen

bestehenden Vertragsbestimmungen:

I. Leistungsbeschreibung

iHaus stellt dem Nutzer den nachfolgend definierten Leistungsgegen­stand zum vertragsgemäßen Gebrauch und zur Nutzung im Rahmen des vertraglich vereinbarten Nutzungszwecks (einschließlich der entsprechenden IT-Ressourcen) auf Grundlage einer Lizenzgewährung zur Verfügung. Die Nutzung ist nur möglich, wenn die jeweiligen Systemanforderungen eingehalten werden. Im Einzelnen gilt Folgendes:

1. Leistungsgegenstand

1.1 iHaus stellt dem Nutzer auf zunächst unbestimmte Zeit einen im Internet gehosteten Telemediendienst sowie Software für die Verwaltung und Steuerung von netzwerkfähigen Geräten und Diensten in Immobilien zur Verfügung (die „iHaus-Services“).

1.2 Die iHaus-Services umfassen derzeit die folgenden Komponenten:

(a) die Bereitstellung und Nutzung von Software auf Basis der Betriebssysteme An­droid oder iOS (die sogenannten „Apps“) für die Verwaltung und Steuerung von netzwerkfähigen Geräten und Diensten in Immobilien;

(b) die Bereitstellung eines Nutzerkontos; und

(c) den Zugriff auf die iHaus-Website.

und zwar dies jeweils mittels mobiler Endgeräte (z.B. Smartphone, Tablet).

1.3 Die iHaus-Services weisen die nachfolgend beschriebene Servicegüte auf:

(a) Alle Leistungen werden im Rahmen der technischen und betrieblichen Machbarkeit sowie der allgemeinen Verfügbarkeit des Internets erbracht.

(b) Zentrale Komponenten und Dienste (einschließlich aller Server- und serverseitigen Datenübertragungsleistungen; zusammenfassend die „zentralen Dienste“) werden von iHaus gesteuert, aber physisch von einem Dritten – derzeit QSC AG oder deren Konzerngesellschaften – betrieben (der „Cloud-Diensteanbieter“).

(c) Die serverseitige Verfügbarkeit der iHaus-Services bestimmt sich nach den allgemeinen Verfügbarkeiten des Cloud-Diensteanbieters sowie unter Berücksichtigung von planmäßigen und außerplanmäßigen Wartungsintervallen (z.B. bei Software-Updates im Hinblick auf Apps oder zentrale Dienste).

(d) Bestimmte Antwort- oder Latenzzeiten für Datenabfragen sowie Datenübertragungsgeschwindigkeiten oder -qualitäten sind nicht geschuldet.

(e) Von dem Leistungsumfang der iHaus-Services nicht umfasst ist der eigentliche Internetzugang, von dem die tatsächliche Verfügbarkeit der iHaus-Services für den einzelnen Nutzer (einschließlich der in Buchstabe (d) genannten Qualitätskriterien) maßgeblich abhängt. Für den Internetzugang hat der Nutzer selbst in eigener Verantwortung zu sorgen.

2. Free-Version ohne Entgeltpflicht / In-App-Käufe / Vertragsgemäßer Gebrauch

2.1 iHaus bietet gegenwärtig nur eine Free-Version der iHaus-Services an, die keiner Entgeltpflicht unterliegt. iHaus behält sich vor, neben oder anstelle dieser Free-Version künftig auch weitere entgeltpflichtige Versionen der iHaus-Services anzubieten. Ebenso behält sich iHaus vor, die Erbringung der iHaus-Services oder einzelner Versionen hiervon vollständig einzustellen; im Fall einer solchen Einstellung der iHaus-Services wird iHaus dies den Nutzern unter Beachtung einer Ankündigungsfrist von zwei Wochen zuvor per E-Mail mitteilen.

2.2 Unbeschadet der grundsätzlichen Entgeltfreiheit der Free-Version der iHaus-Services besteht für den Nutzer die Möglichkeit, bestimmte zusätzliche Inhalte oder Dienste entgeltpflichtig durch In-App-Käufe innerhalb der iHaus-Apps zu erwerben. Die für diese In-App-Käufe geltenden zusätzlichen Bestimmungen sind in Ziffern 4 und 5.2 der AGB festgelegt.

2.3 Die iHaus-Services richten sich an private Personengruppen in Wohnimmobilien überschaubarer Größe sowie kleine und mittlere Unternehmen, die in angemessenem Umfang netzwerkfähige Geräte und Dienste in Gewerberäumen verwalten und steuern wollen.

2.4 Für die Nutzung der iHaus-Services gilt im Rahmen des vereinbarten Nutzungszwecks weiterhin, dass der Nutzer dem Nutzungszweck entsprechend angemessenen Speicher, angemessene Rechenleistung und angemessene Datenübertragungskapazitäten („IT-Ressourcen“) in Anspruch nehmen darf, die für die in vorstehender Ziffer 2.3 beschriebenen Personengruppen oder Organisationen typisch sind. iHaus ist insoweit ins­besondere berechtigt, angemessene IT-Ressourcen-Kontingente oder -Obergrenzen nach billigem Ermessen festzulegen. Außerdem können die Apps bestimmte programmbedingte Obergrenzen enthalten, die vom Nutzer zu beachten sind und deren Einhaltung teilweise programmtechnisch vorgegeben wird.

2.5 Die iHaus-Services dürfen ferner nur im Rahmen der nachstehenden Lizenzeinräumung (Ziffer 4 der Leistungsbeschreibung) und nach Maßgabe der sich aus den AGB (siehe Abschnitt II.) und den Drittlizenzbedingungen (siehe Abschnitt III.) ergebenden Nutzungsbedingungen und sonstigen Bestimmungen genutzt werden.

3. Lizenzeinräumung

Unbeschadet der anwendbaren Lizenzbedingungen für Software Dritter (siehe Drittlizenzbedingungen unter Abschnitt III.), die unabhängig von der nachfolgen­den Einräumung von Nutzungsrechten durch iHaus an den Nutzer gelten, räumt iHaus dem Nutzer im Übrigen an den zur Nutzung der iHaus-Services bereitgestellten Apps und zugehörigen Website-Applikationen sowie den durch den Nutzer im Rahmen von In-App-Käufen etwa erworbenen weiteren Inhalten und/oder Diensten für die Dauer der jeweiligen Vertragslaufzeit ein einfaches, örtlich unbeschränktes Nutzungsrecht ein. Dieses Nutzungsrecht (i) unterliegt den inhaltlichen Beschränkungen, die sich aus dieser Leistungsbeschreibung, insbesondere dem in deren Ziffer 2 bestimmten Nutzungszweck, sowie den AGB und den Drittlizenzbedingungen ergeben und (ii) ist weder unterlizenzierbar noch weiterübertragbar.

4. Systemanforderungen

Eine Nutzung der iHaus-Services ist dem Nutzer nur möglich, wenn die von dem Nutzer eingesetzten IT-Systeme die folgenden Systemanforderungen erfüllen:

4.1 Android-App

Die auf dem Betriebssystem Android laufende App hat folgende Systemanforderungen: Der Nutzer benötigt Android 4.5 oder höher sowie ein entsprechendes Smartphone oder Tablet.

4.2 iOS-App

Die auf dem Betriebssystem iOS laufende App hat folgende Systemanforderungen: Der Nutzer benötigt iOS 8 oder höher sowie ein entsprechendes Smartphone oder Tablet.

4.3 Website

Für die Nutzung der Website ihaus.de benötigt der Nutzer einen HTML5-fähigen Webbrowser.

5. Änderungsvorbehalt

iHaus ist aus betrieblichen Gründen und/oder Gründen der technischen Fortentwicklung jederzeit berechtigt, die Spezifikationen und Funktionalitäten der iHaus-Services gemäß vorstehender Ziffern 1 bis 3 zu verändern (z.B. durch Updates der betreffenden Software). Daraus können sich auch vom Nutzer zu beachtende, veränderte Systemanforderungen (siehe vorstehende Ziffer 4) ergeben.

II. Allgemeine Geschäftsbedingungen

1. Geltungsbereich, Begriffs bestimmungen

1.1 Die nachfolgenden AGB liegen sämtlichen Verträgen über die Nutzung der iHaus-Services zugrunde, die zwischen iHaus und dem Nutzer geschlossen werden. Vor der ersten Nutzung der iHaus-Services muss der Nutzer die Geltung der Vertragsbestimmungen, einschließlich dieser AGB, als verbindlich anerkennen; anderenfalls ist die Nutzung der iHaus-Services nicht möglich.

1.2 Die Bereitstellung der iHaus-Services erfolgt ausschließlich unter der Geltung dieser AGB. Die Geltung entgegenstehender oder von diesen AGB abweichender Geschäftsbedingungen des Nutzers ist ausgeschlossen.

1.3 Diese AGB finden keine Anwendung auf sonstige Leistungen von iHaus außerhalb der iHaus-Services. Dies gilt insbesondere auch für Leistungen über den unter der Webseite ihaus.de erreichbaren iHaus-Store, für die vielmehr gesonderte Allgemeine Geschäftsbedingungen gelten.

1.4 Sofern in diesen AGB von „Verbrauchern“ die Rede ist, sind dies gemäß § 13 BGB natürliche Personen, die ein Rechtsgeschäft zu einem Zweck abschließen, der weder ihrer gewerblichen noch ihrer selbständigen beruflichen Tätigkeit zugerechnet werden kann. „Unternehmer“ sind dagegen natürliche oder juristische Personen oder rechtsfähige Personengesellschaften, die bei Abschluss eines Rechtsgeschäfts in Ausübung ihrer gewerblichen oder selbständigen beruflichen Tätigkeit handeln, § 14 Abs. 1 BGB. „Nutzer“ im Sinne dieser AGB sind sowohl Verbraucher als auch Unternehmer.

1.5 Die AGB sind jederzeit innerhalb der iHaus-Apps unter „Vertragsbestimmungen“ einsehbar. Außerdem kann dieses sämtliche geltenden Vertragsbestimmungen (Leistungsbeschreibung, AGB, Drittlizenzbedingungen) enthaltende Dokument ausgedruckt, in ein PDF konvertiert oder gespeichert werden.

2. Registrierung und Einrichtung eines Nutzerkontos, Vertragsschluss / Vertragsdurchführung

2.1 Für die Nutzung der iHaus-Services ist die Einrichtung eines Nutzerkontos erforderlich, für das sich jeder Nutzer registrieren muss. Teilnahmeberechtigt sind natürliche Personen ab 18 Jahren, die unbeschränkt geschäftsfähig sind, sowie juristische Personen. Die Nutzung durch automatisierte Einrichtungen (Robots) ist nicht gestattet. Jeder Nutzer ist allein dafür verantwortlich, dass die von ihm für die Registrierung gemachten Angaben vollständig und wahrheitsgemäß sind.

2.2 Ein Vertrag über die Nutzung der iHaus-Services kommt erst zustande, wenn iHaus dem Nutzer per E-Mail einen Aktivierungslink für das Nutzerkonto übermittelt und der Nutzer hiernach die Einrichtung des Nutzerkontos durch Klicken auf diesen Aktivierungslink bestätigt. Erst mit Zugang dieser Aktivierungsbestätigung des Nutzers bei iHaus beginnt das Vertragsverhältnis. Die Registrierung für die iHaus-Services und die Einrichtung eines Nutzerkontos sind nicht einklagbar und können auch nicht in anderer Form verlangt werden.

2.3 Jeder Nutzer kann sich mit seinen persönlichen Zugangsdaten über die iHaus-App in seinem persönlichen Nutzerkonto anmelden.

2.4 Zur Kontaktaufnahme im Rahmen der weiteren Vertragsdurchführung nutzt iHaus die E-Mail-Adresse, die vom Nutzer bei der Registrierung gegenüber iHaus angegeben wurde. iHaus weist darauf hin, dass dem Nutzer rechtsgeschäftliche Erklärungen (z.B. Änderungen der AGB, siehe Ziffer 9 der AGB) per E-Mail zugehen können.

3. Allgemeine Nutzungsbedingungen

3.1 Der Nutzer darf die iHaus-Services nach Maßgabe der Leistungsbeschreibung, dieser AGB und der Drittlizenzbedingungen für seine eigenen Zwecke nutzen. Jegliche rechtswidrige Nutzung der iHaus-Services, insbesondere eine solche, die gegen gesetzliche Verbote in der Bundesrepublik Deutschland oder am Wohn- bzw. Geschäftssitz des Nutzers und/oder gegen Rechte Dritter verstoßen, ist untersagt. Wenn und soweit netzwerkfähige Gerät oder Dienste nach deutschem Recht und/oder dem für den Nutzer geltenden lokalen Recht nicht besessen oder genutzt werden dürfen, so ist auch deren Erfassung sowie Verwaltung und Steuerung mit iHaus nicht gestattet. Der Nutzer sichert ferner zu, dass (i) er sich nicht in einem Land befindet, über das die US­amerikanische Regierung ein Embargo verhängt hat oder das die US­amerikanische Regierung als „Terroristen­unterstützendes Land“ klassifiziert hat und, dass (ii) er nicht auf einer Liste verbotener oder eingeschränkter Parteien der US-Regierung vermerkt ist.

3.2 Ungeachtet darüber hinausgehender und vom Nutzer zu beachtender gesetzlicher Verbote dürfen mit den iHaus-Services keine volksverhetzenden, gewaltverherrlichenden, pornographischen, gegen Artenschutzabkommen verstoßende, terroristischen Zwecken dienende, nationalsozialistische oder sonstige rassistische Gegenstände als Nutzerinhalte erstellt oder mit den iHaus-Services verwaltet werden. Die iHaus-Services dürfen nicht für die Entwicklung, den Bau, den Betrieb oder die Instandhaltung nuklearer Einrichtungen verwendet werden.

3.3 Der Zugriff auf den iHaus-Server und die darauf befindlichen APIs (d.h. Programmierschnittstellen) und Inhalte ohne Nutzung der iHaus-Apps ist ohne ausdrückliche und vorherige Zustimmung von iHaus nicht gestattet.

3.4 Für Nutzerinhalte, insbesondere Bezeichnungen und Beschreibungen, und deren Rechtmäßigkeit nach Maßgabe der vorstehenden Bestimmungen ist allein der Nutzer verantwortlich. iHaus ist dem Nutzer gegenüber nicht verpflichtet, die Nutzerinhalte und deren Rechtmäßigkeit zu überprüfen.

3.5 iHaus ist allerdings berechtigt, Nutzerinhalte zu löschen und/oder einen Nutzer zu sperren, sofern konkrete Anhaltspunkte dafür vorliegen, dass die von dem Nutzer und/oder einem Dritten eingestellten Inhalte gegen gesetzliche Vorschriften, Rechte Dritter oder diese AGB verstoßen. Sollte das Nutzerkonto gesperrt worden sein, kann sich der Nutzer per E-Mail an support@ihaus.com wenden und um Erläuterung seiner Sperrung bitten. Weitergehende Rechte von iHaus, insbesondere eine außerordentliche Kündigung des Vertragsverhältnisses aus wichtigem Grund, bleiben ausdrücklich unberührt.

3.6 Der Nutzer ist verpflichtet, die Zugangsdaten für das Nutzerkonto (insbesondere einschließlich Nutzernamen und Passwort) vertraulich zu behandeln und in angemessener Weise vor dem Zugriff unbefugter Dritter zu schützen. Es ist Nutzern nicht gestattet, diese Zugangsdaten Dritten zugänglich zu machen.

3.7 Jegliche schuldhafte Störung der iHaus-Apps oder iHaus-Website oder die missbräuchliche Nutzung der darin vorgehaltenen Nutzerinhalte und Daten ist untersagt.

3.8 Für den Fall eines unangemessenen Ressourcenverbrauchs (z.B. weit überdurchschnittliche Anzahl eingebundener Geräte und Dienste sowie Datenmengen) durch den Nutzer behält iHaus sich das Recht vor, dem Nutzer die weitere Nutzung der iHaus-Services zu untersagen oder die Nutzung zu beschränken und das Nutzerkonto auf ein der durchschnittlichen Nutzung entsprechendes Maß zu reduzieren.

3.9 Der Nutzer ist ferner verpflichtet, sämtliche Gebrauchsanweisungen und Herstellerhinweise für Hardware, Software oder sonstige Dienste (insbesondere Smart Home-Komponenten) zu beachten, die der Nutzer mit den iHaus-Services verbindet.

4. In-App-Käufe

4.1 Vertragsschluss bei In-App-Käufen

Die iHaus-Apps ermöglichen es dem Nutzer, innerhalb der App weitere Inhalte oder Dienste durch In-App-Kauf entgeltpflichtig zu erwerben. Das jeweils verfügbare Angebot solcher In-App-Käufe, einschließlich einer Beschreibung der Eigenschaften der jeweiligen Inhalte oder Dienste sowie der jeweils für diese anfallenden Entgelte, ist in den iHaus-Apps unter der Rubrik „Einkäufe“ abrufbar. Ein Vertrag über den Erwerb des jeweiligen Inhalts oder Dienstes kommt zwischen iHaus und dem Nutzer zustande, sobald der Nutzer den betreffenden Inhalt oder Dienst ausgewählt und dessen Erwerb innerhalb der Bestellübersicht durch Tippen auf die Schaltfläche „zahlungspflichtig bestellen“ bestätigt hat.

4.2 Widerrufsrecht für Verbraucher

Verbraucher haben in Bezug auf In-App-Käufe gemäß Ziffer 4.1 dieser AGB folgendes Widerrufsrecht:

Sie haben das Recht, binnen vierzehn Tagen ohne Angabe von Gründen diesen Vertrag zu widerrufen. Die Widerrufsfrist beträgt vierzehn Tage ab dem Tag des Vertragsabschlusses.

Um Ihr Widerrufsrecht auszuüben, müssen Sie uns, iHaus AG, Siedlerstraße 2, 85774 Unterföhring, Telefon: +49 89 9959059-0, Telefax: +49 89 9959059-40, E-Mail: info@ihaus.de, mittels einer eindeutigen Erklärung (z.B. ein mit der Post versandter Brief, Telefax oder E-Mail) über Ihren Entschluss, diesen Vertrag zu widerrufen, informieren. Sie können dafür das beigefügte Muster-Widerrufsformular verwenden, das jedoch nicht vorgeschrieben ist.

Zur Wahrung der Widerrufsfrist reicht es aus, dass Sie die Mitteilung über die Ausübung des Widerrufsrechts vor Ablauf der Widerrufsfrist absenden.

Folgen des Widerrufs

Wenn Sie diesen Vertrag widerrufen, haben wir Ihnen alle Zahlungen, die wir von Ihnen erhalten haben, einschließlich der Lieferkosten (mit Ausnahme der zusätzlichen Kosten, die sich daraus ergeben, dass Sie eine andere Art der Lieferung als die von uns angebotene, günstigste Standardlieferung gewählt haben), unverzüglich und spätestens binnen vierzehn Tagen ab dem Tag zurückzuzahlen, an dem die Mitteilung über Ihren Widerruf dieses Vertrags bei uns eingegangen ist. Für diese Rückzahlung verwenden wir dasselbe Zahlungsmittel, das Sie bei der ursprünglichen Transaktion eingesetzt haben, es sei denn, mit Ihnen wurde ausdrücklich etwas anderes vereinbart; in keinem Fall werden Ihnen wegen dieser Rückzahlung Entgelte berechnet.

 

4.3 Muster-Widerrufsformular

Sofern ein Widerrufsrecht gemäß Ziffer 4.1 dieser AGB besteht und dieses auch nicht gemäß Ziffer 4.4 dieser AGB wieder erloschen sein sollte, gilt Folgendes:

 

Wenn Sie den Vertrag nach Maßgabe der vorstehenden Ziffer 4.2 dieser AGB widerrufen wollen, dann können Sie dieses Formular ausfüllen und an uns zurücksenden. Die Verwendung des Formulars ist aber nicht zwingend.

4.4 Erlöschen des Widerrufsrechts

Das Widerrufsrecht gemäß Ziffer 4.2 dieser AGB erlischt, wenn iHaus mit der Ausführung des Vertrags begonnen hat, nachdem der Verbraucher ausdrücklich zugestimmt hat, dass iHaus mit der Ausführung des Vertrags vor Ablauf der Widerrufsfrist beginnt, und der Verbraucher seine Kenntnis davon bestätigt hat, dass er durch seine Zustimmung mit Beginn der Ausführung des Vertrags sein Widerrufsrecht verliert.

5. Free-Version: Unentgeltlichkeit der Leistungserbringung / In-App-Käufe / Ausländische Steuern und Abgaben

5.1 Die Erbringung der iHaus-Services in der Free-Version erfolgt unentgeltlich.

5.2 Soweit der Nutzer bestimmte Inhalte und/oder Dienste durch einen In-App-Kauf gemäß Ziffer 4. dieser AGB erwirbt, findet das jeweils in der App angegebene Entgelt Anwendung. Alle dabei jeweils angegebenen Entgelte verstehen sich als Gesamtpreise in Euro, die eine etwa anfallende deutsche gesetzliche Umsatzsteuer enthalten. Die Zahlungsabwicklung erfolgt über den jeweiligen Betreiber des App-Stores (Google Play Store, Apple App Store), der dabei als Zahlungsdienstleister für iHaus auftritt, nach Maßgabe der im jeweiligen App-Store angebotenen Zahlungsmodalitäten und unter Nutzung der vom Nutzer dort hinterlegten Zahlungsdaten.

5.3 Etwa außerhalb der Bundesrepublik Deutschland im Zusammenhang mit der Nutzung der iHaus-Services durch den Nutzer anfallende Steuern, Abgaben und ähnliche Lasten trägt der Nutzer.

6. Laufzeit / Kündigung

6.1 Verträge über die Erbringung von iHaus-Services werden auf unbestimmte Zeit geschlossen.

6.2 Beide Parteien sind jederzeit berechtigt, das Vertragsverhältnis unter Beachtung einer Kündigungsfrist von zwei Wochen zu kündigen.

6.3 Das Recht beider Parteien zur außerordentlichen Kündigung aus wichtigem Grund bleibt unberührt.

6.4 Jede Kündigung bedarf zu ihrer Wirksamkeit der Schriftform, sofern die Kündigung nicht nach ordnungsgemäßer Anmeldung in das Nutzerkonto über eine dafür etwa bereit gestellte Funktionalität innerhalb der iHaus-App erfolgt.


7. Einräumung von Nutzungsrechten / Open Source Software / Schutzrechte Dritter

7.1 iHaus räumt dem Nutzer Nutzungsrechte an der vertragsgegenständlichen Software nur in dem in der Lizenzeinräumung gemäß Ziffer 3 der Leistungsbeschreibung bestimmten Umfang ein.

7.2 Die iHaus-Apps enthalten unter anderem Open Source Software. Eine Einräumung von Nutzungsrechten an dieser Open Source Software erfolgt nicht durch iHaus, sondern vielmehr ausschließlich in dem Umfang und mit den Maßgaben, die die Lizenzgeber dieser Open Source Software in den anwendbaren Lizenzbedingungen (siehe Abschnitt III. – „Drittlizenzbedingungen“) festgelegt haben. iHaus weist auf die Geltung dieser Drittlizenzbedingungen hiermit ausdrücklich hin. Der Nutzer ist auch gegenüber iHaus zur Einhaltung dieser Drittlizenzbedingungen verpflichtet.

7.3 Falls bezüglich der in vorstehender Ziffer 7.1 in Bezug genommenen Nutzungsrechte eine Verletzung von Schutzrechten Dritter geltend gemacht wird oder droht, ist iHaus berechtigt, nach eigener Wahl und auf eigene Kosten für den Nutzer das Recht auf fortgesetzte Nutzung zu sichern oder die iHaus-Services gemäß der Leistungsbeschreibung zu modifizieren, um hierdurch Verletzungen von Schutzrechten zu verhindern oder die Erbringung der iHaus-Services vorübergehend einzustellen. Jegliche Ansprüche des Nutzers sind dabei ausgeschlossen, wenn und soweit sich die Rechtsverletzung auf eine unerlaubte Veränderung der iHaus-Services oder der zu deren Erbringung eingesetzten Software durch den Nutzer oder deren sonstige Nutzung durch den Nutzer unter Verstoß gegen die Bestimmungen der Leistungsbeschreibung, der AGB oder der Drittlizenzbedingungen bezieht. Das Recht von iHaus, die Erbringung der iHaus-Services gemäß Ziffer 2.1 der Leistungsbeschreibung vollständig einzustellen, bleibt unberührt.

8. Haftung

Jegliche Haftung von iHaus auf Schadens- und/oder Aufwendungsersatz aus oder im Zusammenhang mit dem Vertragsverhältnis zwischen iHaus und dem Nutzer unterliegt den nachfolgenden Beschränkungen:

8.1 Bei Vorsatz oder grober Fahrlässigkeit, Übernahme einer Beschaffenheits- und/oder Haltbarkeitsgarantie sowie arglistigem Verschweigen eines Mangels haftet iHaus gemäß den gesetzlichen Bestimmungen.

8.2 Bei leichter Fahrlässigkeit haftet iHaus im Fall der Verletzung des Lebens, des Körpers oder der Gesundheit unbeschränkt. Im Übrigen haftet iHaus bei leichter Fahrlässigkeit nur bei Verletzung einer Kardinalpflicht und nur für den vertragstypischen, vorhersehbaren Schaden. Unter einer Kardinalpflicht ist eine wesentliche Vertragspflicht zu verstehen, deren Erfüllung die ordnungsgemäße Durchführung des Vertrages überhaupt erst ermöglicht und auf deren Einhaltung der Nutzer regelmäßig vertrauen darf.

8.3 Eine verschuldensunabhängige Haftung von iHaus gemäß § 536a BGB für etwaige bei Vertragsschluss vorhandene Mängel ist ausgeschlossen; Ziffern 8.1 und 8.2 bleiben unberührt.

8.4 Die Haftung nach den Vorschriften des Produkthaftungsgesetzes bleibt unberührt.

9. Datenschutz

9.1 iHaus nutzt die im Rahmen der Erbringung der jeweiligen Dienstleistung erhobenen und/oder durch den Nutzer übermittelten personenbezogenen Daten nur im Rahmen des Vertragsverhältnisses mit dem Nutzer. Dies umfasst auch die Weitergabe dieser personenbezogenen Daten an mit der Vertragsdurchführung beauftragte Dritte, soweit dies zur Erbringung der iHaus-Services erforderlich ist.

9.2 iHaus erhebt, verarbeitet und nutzt personenbezogene Daten gemäß den jeweils anwendbaren gesetzlichen Bestimmungen, insbesondere den Regelungen des Bundesdatenschutzgesetzes und des Telemediengesetzes. iHaus beachtet die Grundsätze der Datenvermeidung und Datensparsamkeit. Die weiteren Einzelheiten der Erhebung, Verarbeitung und Nutzung personenbezogener Daten durch iHaus ergeben sich aus der Datenschutzerklärung.

10. Änderung der Allgemeinen Geschäftsbedingungen

10.1 iHaus ist berechtigt, diese AGB – soweit sie in das Vertragsverhältnis mit dem Nutzer einbezogen sind – einseitig zu ändern, soweit dies zur Anpassung an eine Veränderung der Gesetzeslage oder höchstrichterlichen Rechtsprechung oder sonstiger Marktgegebenheiten, insbesondere technischer Rahmenbedingungen, zweckmäßig oder notwendig erscheint.

10.2 Über eine solche Anpassung wird der registrierte Nutzer unter Mitteilung des Inhalts der geänderten Regelungen per E-Mail informiert. Die jeweilige Änderung wird Vertragsbestandteil, wenn der Nutzer nicht binnen sechs Wochen nach Zugang der Änderungsmitteilung einer Einbeziehung in das Vertragsverhältnis gegenüber iHaus in Schrift- oder Textform widerspricht.

11. Schlussbestimmungen

11.1 Sofern eine Bestimmung dieser AGB unwirksam ist, bleiben die übrigen Bestimmungen davon unberührt. An Stelle der unwirksamen Bestimmung treten die anwendbaren gesetzlichen Regelungen.

11.2 Auf diese AGB und die gesamten Rechtsbeziehungen zwischen iHaus und dem Nutzer findet das Recht der Bundesrepublik Deutschland unter Ausschluss der Bestimmungen des internationalen Privatrechts, die in eine andere Rechtsordnung verweisen, und des UN-Kaufrechts (CISG) Anwendung. Dies gilt auch, soweit der Nutzer seinen Wohnsitz in einem anderen Staat als der Bundesrepublik Deutschland hat. Diese Rechtswahl gilt gegenüber Verbrauchern jedoch nur insoweit, als nicht der gewährte Schutz durch zwingende Bestimmungen des Rechts des Staates, in dem der Verbraucher seinen gewöhnlichen Aufenthalt hat, entzogen wird.

11.3 Im Geschäftsverkehr mit Kaufleuten, juristischen Personen des öffentlichen Rechts oder öffentlich-rechtlichen Sondervermögen ist München Gerichtsstand für alle Rechtsstreitigkeiten aus oder im Zusammenhang mit diesen Allgemeinen Geschäftsbedingungen.

Recipient agrees to cease use and distribution of the Program as soon as

2.2 iHaus und der Nutzer erkennen hiermit an, dass das EULA zwischen iHaus und dem Nutzer geschlossen wird und iHaus allein für die iOS-App und darin von iHaus bereit gestellte Inhalte verantwortlich ist und nicht Apple Inc., eine Gesellschaft nach dem Recht des US-Bundesstaates Kalifornien („Apple“).

2.8 Der Nutzer hat die von ihm eingegangenen einschlägigen Vertragsbestimmungen Dritter beim Benutzen der Lizenzierten Applikation einzuhalten (z.B. die Vertragsbestimmungen seines Mobilfunkvertrags).

2.9 iHaus und der Nutzer erkennen an und sind damit einverstanden, dass Apple und die Apple-Tochtergesellschaften im Hinblick auf die Nutzung der Lizenzierten Applikation und den damit im Zusammenhang stehenden Rechten Drittbegünstigte des EULA sind und dass Apple, sofern der Endnutzer den Vertragsbestimmungen zugestimmt hat, das Recht hat (und das Recht als angenommen gilt), das EULA insoweit als Drittbegünstigter gegen den Nutzer durchzusetzen.
